Terms of Service

1. Acceptance of Terms

By accessing or using Generative Cats (“the Service”), operated by Generative Cats LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance of the revised terms.

2. Service Description

Generative Cats is a community-first generative art platform where users create unique AI-generated cat cards. Users can generate original cats, remix existing cats, and merge cats from different creators to form new lineages. All content exists within a shared cosmos organized into galaxies, star systems, and planets.

3. Accounts

You sign in using Google Authentication. We do not create or store passwords. Your account is tied to your Google account and you are responsible for maintaining the security of your Google credentials. You may only maintain one account. We reserve the right to suspend or terminate accounts that violate these terms.

4. AI-Generated Content

All cat images are generated using Google's Imagen 4 Ultra AI model, and text content (names, lore, traits) is generated using Google's Gemini models. You provide a creative prompt; the AI interprets it to produce the output.

• AI outputs may not match your expectations — generation is inherently unpredictable.
• Generated content is not guaranteed to be unique across all AI platforms.
• We do not guarantee that AI-generated content is free from imperfections or biases.
• You may not use the Service to generate content that is illegal, harmful, or violates the rights of others.

5. User Prompts and Responsibilities

You are responsible for the prompts you submit. Prompts are processed through safety filters, but you agree not to attempt to generate content that is:

• Sexually explicit, violent, or depicting abuse
• Hateful, discriminatory, or promoting harm against individuals or groups
• Infringing on the intellectual property of others
• Designed to circumvent content safety systems

We may moderate, remove, or restrict content and accounts that violate these guidelines at our sole discretion.

6. Intellectual Property

You retain rights to the creative prompts you provide. The AI-generated outputs (images, names, lore) are produced collaboratively between your input and the AI model. You may use your generated cats for personal, non-commercial purposes. By using the Service, you grant us a non-exclusive license to display your generated content within the platform (cosmos, feeds, lineage graphs, and promotional materials for the Service).

The Generative Cats platform, its design, code, and branding are the intellectual property of Generative Cats LLC.

7. Subscriptions and Payments

All payments are processed by Polar.sh, which acts as the Merchant of Record. Polar handles payment processing, tax compliance (VAT, GST, sales tax), invoicing, and refunds. By subscribing, you also agree to Polar's Terms of Service.

8. Free Tier

Free accounts receive a limited number of lifetime generations at no cost. No credit card is required. Free access is subject to monthly capacity limits; when the platform is at capacity, new free signups may be placed on a waitlist. Paid subscribers always have instant access.

9. Cancellation

You may cancel your subscription at any time through Polar's billing portal. Upon cancellation, you retain access to your paid features through the end of your current billing period. After that, your account reverts to the free tier. Your generated cats and lineage data are preserved regardless of subscription status.

10. Community Standards

Generative Cats is a collaborative platform. Reactions, remixes, and merges are creative acts that connect creators across the cosmos. You agree to engage respectfully with other creators and their work. Harassment, spam, or intentional disruption of the community experience may result in account suspension or termination.

11. Prohibited Uses

You may not:

• Use automated tools, bots, or scripts to access the Service
• Attempt to reverse-engineer, decompile, or extract the AI models
• Resell, sublicense, or commercially distribute generated content without permission
• Use the Service to generate training data for competing AI models
• Circumvent rate limits, capacity controls, or security measures
• Impersonate other users or misrepresent your identity

12. Termination

We may suspend or terminate your account at our discretion for violation of these terms. Upon termination, your access to the Service ceases. Generated content that has been remixed or merged by other creators remains in the cosmos as part of the shared lineage. You may request deletion of your account data by contacting support.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements. AI generation may produce unexpected, imperfect, or inconsistent results.

14. Limitation of Liability

To the maximum extent permitted by law, Generative Cats LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Oregon.
